Justice klaps father who raped his daughter

The 77-year-old father who raped his teenage daughter in 2010 and 2012 appealed his sentence, but he did not get the positive outcome he had hoped for.

Instead, on Tuesday, the Bisho High Court in the Eastern Cape set aside his May 2014 sentence of 22 years imprisonment and sentenced him to life imprisonment.

According to NPA spokesperson Anelisa Ngcakani, on 9 May 2014, the Zwelitsha Regional Court sentenced the father to 22 years of direct imprisonment.

The daughter was 15 years old in 2010. The rapes occurred at their home in the Mgxotyeni area.

“On both occasions, the daughter was threatened physically,” said Ngcakani.

“In September 2012, he took the threats a step further and said he would stab her with a sword he had in his hand.”

Afterwards, the father instructed her to wipe herself with a handkerchief which he kept locked away.

“The girl broke her silence four days after the rape, in September 2012, after police had visited her school to educate learners about the importance of reporting domestic violence,” said Ngcakani.

“She raised her hand, cried, and told the police what had happened.”

The girl went home and asked her father for the handkerchief under the pretence that she needed to wash it.

“He told her to fetch it from the room then grabbed and kissed her with his tongue,” said Ngcakani.

She then handed the handkerchief over to the police.

The DNA found on the handkerchief linked the father to the rapes. He then admitted that he had sexual intercourse with his daughter but claimed that she consented. 

The prosecutor representing the state, Advocate Nocwaka Blorweni-Tokota, argued the 22-year sentence was an injustice and a sentence of life imprisonment should be imposed.

Acting Director of Public Prosecutions Livingstone Sakata commended the investigation and prosecution teams for their hard work.
