Ace Magashule, returns to the High Court to demand that it overturns a decision it has already made

Ace Magashule will continue with his fight to have his full-time ANC secretary-general position back at the South Gauteng High Court on Wednesday.

He is appealing the court’s decision that dismissed his application to have his suspension from the ANC overturned – and he is appealing it in the same court that made the decision in the first place.

He told Scrolla.Africa before the proceedings started that he would approach the Supreme Court of Appeals if the court rules against him.

He also wants the court to enforce his bizarre suspension of President Cyril Ramaphosa in his capacity as ANC president.

When the ANC suspended Magashule in May, he retaliated by suspending Ramaphosa. 

While no structure of the ANC endorsed Magashule’s dubious action, these were early warning shots that he would not go down without a fight to save his political career.

In his application, he cites the ANC, its president Ramaphosa, ANC Deputy Secretary-General Jessie Duarte as respondents. 

He accuses Ramaphosa of appointing people who have corruption charges hanging over their heads to his cabinet.

Among them was the recently-appointed Minister in the Presidency Mondli Gungubele, Finance Minister Enoch Gondongwana, Zizi Kodwa Deputy Minister in the Presidency. 

He also questions why Ramaphosa did not retain Gwede Mantashe as Minerals and Energy Minister.  

Magashule maintains that his suspension pending the outcome of his R255 million asbestos case is a political ploy to block him from contesting leadership positions.

Magashule is adamant that only the branches of the ANC can remove him from his powerful secretary-general position.

He was elected in the 2017 ANC elective conference in Nasrec, Joburg. 

Despite his suspension, Magashule still receives his R133 000 a month salary from the ANC.
