The Kuilsriver Magistrate’s Court in Cape Town has released 19-year-old Luvo Gqaza on a warning after he was seen assaulting his grandmother in a viral video on social media.

Luvo was arrested the same day the video surfaced and first appeared in court on 5 July.

National Prosecuting Authority spokesperson Eric Ntabazalila said the court granted protection to the Sindisiwe Gqaza and released her grandson on a warning with conditions, including attending his trial.

“He must stay at 21299 Jafta Street, Bloekombos, attend school regularly, and be under house arrest from Friday afternoon until Monday morning,” said Ntabazalila.

Gqaza’s case was postponed to 27 September.

Before his release, he was held in the hospital section of Pollsmoor Prison because he was allegedly suicidal.

Resident Esona Mgwetyana said he was worried about Gqaza’s gogo.

“It breaks my heart to see the elderly being abused by their grandchildren or children, and then we always blame drugs because they affect how they behave,” said Mgwetyana.

A resident, speaking anonymously, said: “He might be released on a warning, but this is going to affect him badly. At school, they won’t look at him the same way before he trended on social media.

“We know our kids are bullies, and they are going to make sure he feels the heat.

“Luvo must face the music. It was his choice to take drugs and abuse his grandmother … his life will never be the same again.”
