The Durban High Court has delayed its decision on the ANC’s appeal against the April ruling allowing the MK party to use its name and logo.
Judge Mahendra Chetty did not say when the judgement would be given.
The ANC’s lawyer, Adv Gavin Marriot, said the MK Party’s use of the logo would confuse voters. He said it would cause problems during elections, conferences and other events.
Marriot asked Judge Chetty to let them take the case to the Supreme Court of Appeal (SCA), saying another court might rule differently.
MK’s lawyer, Adv Dali Mpofu SC, said the ANC was trying to reargue the case they lost in April.
He said the appeal was “dead on arrival”.
“If there ever was a hopeless appeal, this is the one,” Mpofu said in court.
He said that the elections were over, making the appeal pointless.
“The harm was done during the elections and you can’t change that now. The horse has bolted and the train has left the station,” Mpofu said.
Zuma was in court to listen to the arguments.
ANC leaders from both KwaZulu-Natal and the national office were absent.
Supporters of the MK Party were outside the court, while no ANC supporters were seen.
