Supreme Court throws out Dr Nandipha’s arrest appeal

  • The Supreme Court of Appeal ruled against Dr Nandipha Magudumana, rejecting her bid to overturn her arrest.
  • She was caught in Tanzania with her lover Thabo Bester, who escaped from prison with her alleged help.

The Supreme Court of Appeal has dismissed Dr Nandipha Magudumana’s attempt to have her arrest declared unlawful.

Justice Tati Makgoka handed down the judgment on Friday, stating that her application was dismissed with costs.

Magudumana had taken the case to the appeal court after the High Court ruled against her.

She was arrested in Tanzania in 2023 while on the run with her lover and accomplice, Thabo Bester.

Bester is a convicted murderer who escaped from Mangaung prison, where he was serving a life sentence.

Magudumana is accused of helping Bester escape from the prison.

She was allegedly part of the plot that included faking Bester’s death in a fire, and later fleeing the country with him.

Her legal team argued that her arrest was unlawful and that she should have been extradited formally, but the courts disagreed.
