The Western Cape High Court has thrown out a case by 10 Umkhonto weSizwe (MK) Party MPs trying to stop their removal from Parliament.

The court ordered them to pay costs.

The MPs, including Thami Khuzwayo and Isaac Menyatso, lost because their court papers were not completed correctly.

The court said their papers left out important facts. They did not state they were MK Party members when they joined Parliament or whether they had been expelled.

The court also said that the MK Party’s rules, which Khuzwayo claimed he had attached, were missing.

Some MPs filed late statements on the hearing date of 3 September without permission.

These contained new facts the MK Party could not respond to.

The MPs did not challenge former president Jacob Zuma’s statement. Zuma portrayed a concerning picture of how the MK Party operates, ignoring its own rules.

The MK Party Youth League welcomed the ruling, saying it serves as a lesson to those putting themselves before the party.

The MPs have not yet commented.
