Vodacom said it is disappointed and saddened at the latest Supreme Court of Appeal (SCA) decision delivered on Tuesday in the battle between the tech giant and entrepreneur Nkosana Makate, the acclaimed creator of its “Please Call Me” facility.

In a statement, the tech giant said: “Vodacom notes the judgment of the SCA of South Africa in the case of Vodacom v Makate which was handed down on 6 February 2024.”

Vodacom said it will appeal the judgment before the Constitutional Court.

The SCA on Tuesday dismissed an appeal by Vodacom and ruled that it must pay Makate between 5% and 7.5% of the total voice revenue generated over 18 years, plus interest.

But on Wednesday, Vodacom decided to take its fight with Makate on review to the Constitutional Court, the highest court in the land.

Makate was seeking a review of the $2.5-million (R47-million) compensation offered by the company.
