Suspended Deputy National Police Commissioner Shadrack Sibiya will remain in custody until Thursday, when his bail hearing is due to conclude before the Randburg Magistrate’s Court.
Sibiya faces charges of rape, sexual grooming of a minor, and human trafficking, all of which he denies.
He was arrested last week at a Sandton strip club, after police say they obtained evidence they allege shows he groomed a minor, the 16-year-old daughter of a close associate of his.
The state alleges Sibiya exchanged explicit messages with the minor over WhatsApp, and that he was in possession of explicit material involving her. Sibiya maintains he has never had a sexual relationship with the child.
Through his lawyer, Estelle Killian, he told the court he received the material from the girl’s own father, who he said was distressed and disappointed after discovering it, and had sent it to him in confidence. His affidavit, read to the court by Killian, stated: “He was disturbed and told me he received a video of his daughter… from an undisclosed source. He forwarded this video to me while expressing his disappointment.”
Sibiya further claims the father told him his daughter had feelings for him, and that he then confronted her about this directly over WhatsApp. His bail hearing will resume on Thursday.
Separately, Sibiya faces a disciplinary hearing next week.
Police spokesperson Brigadier Athlenda Mathe confirmed Sibiya was formally served with notice of an expedited disciplinary hearing set down for 5 October, over corruption-related allegations arising from the Madlanga Commission of Inquiry, an entirely separate process from the criminal case above.
Mathe said the hearing falls under Regulation 9, reserved for serious corruption allegations, and follows the finalisation of an internal departmental investigation.
Sibiya must be physically present for the hearing to proceed; if he remains in custody, it will be held at Kgosi Mampuru Correctional Centre, and if released on bail, the venue will be communicated to him separately.
